InstDat Terms and Conditions

Introduction

InstDat, powered by CAUL CONSULT (CaulSult), provides a digital data management platform (the "Service") to businesses and individuals (the "User"). By accessing or using the Service, you agree to be bound by these Terms and Conditions.

Definitions

  • "Service" means the InstDat platform and all related services.
  • "User" means the individual or business using the Service.
  • "Data" means any information or content uploaded, stored, or processed through the Service.

Terms of Use

  • Eligibility: The Service is intended for businesses and individuals.
  • Registration: Users must provide accurate and complete registration information.
  • Account Security: Users are responsible for maintaining the confidentiality and security of their account credentials.
  • Prohibited Use: Users shall not:
    • Use the Service for unlawful or harmful purposes.
    • Upload or transmit malicious software or data.
    • Interfere with the Service's operation or other users' accounts.
    • Breach applicable laws and regulations.

Data Management

  • Data Ownership: Users retain ownership of their Data.
  • Data Storage: CaulSult stores Data securely, in accordance with industry standards.
  • Data Access: CaulSult may access Data for maintenance, support, and troubleshooting purposes.
  • Data Backup: Users are responsible for backing up their Data.

Free Trial Subscription - Data Retention and Deletion

Users who subscribe to the free trial subscription agree to the following data retention and deletion terms:

  • Product-related data will be deleted one (1) month after the end of the free trial validity.
  • Email addresses will be retained for six (6) months after the end of the free trial validity for communication purposes, including notifications about subscription renewal, promotional offers, and product updates.

Payment and Subscription

  • Fees: Users agree to pay applicable subscription fees.
  • Payment Terms: Payment is due upon subscription renewal.

Disclaimer and Limitation of Liability

  • Disclaimer: The Service is provided "as-is" and "as-available".
  • Limitation of Liability: CaulSult's liability is limited to direct damages, capped at the annual subscription fee.

Termination

  • Termination: CaulSult may terminate or suspend the Service upon breach of these Terms.
  • Effect of Termination: Upon termination, User's access to the Service and Data will cease.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Lagos/Nigeria. Any disputes shall be resolved through binding arbitration.

Changes to Terms

CaulSult reserves the right to modify these Terms. Changes will be effective upon posting.
