InstDat, powered by CAUL CONSULT (CaulSult), provides a digital data management platform (the "Service") to businesses and individuals (the "User"). By accessing or using the Service, you agree to be bound by these Terms and Conditions.

Definitions

  • "Service" means the InstDat platform and all related services.
  • "User" means the individual or business using the Service.
  • "Data" means any information or content uploaded, stored, or processed through the Service.
  • "Account" means the personalized account setup for a User, granting access to our Service or specific sections of it.
  • "Device" refers to any hardware capable of accessing our Service, such as a computer, smartphone, or tablet.
  • "Personal Data" refers to any information that relates to an individual who can be identified or is identifiable, either directly or indirectly.

Subscription - Data Retention and Deletion

Users who subscribe to a subscription service agree to the following data retention and deletion terms:

  • Product-related data will be deleted at our discretion, typically within one (1) month after the subscribed service's validity period ends. The exact timing may depend on our system status and requirements.
  • Account email address will be retained for at least six (6) months after the end of the subscription validity for communication purposes, including notifications about subscription renewal, promotional offers, and product updates.
    • You may request access to, modification of, or deletion of your personal information that you have provided to us, contact us directly. Certain User information or Account may be retained by us if required by law or if we have a legitimate legal basis for doing so.

Payment and Subscription

  • Fees: Users agree to pay applicable subscription fees.
  • Payment Terms: Payment is due upon subscription renewal.

Disclaimer and Limitation of Liability

  • Limitation of Liability: CaulSult's liability is limited to direct damages, capped at the annual subscription fee.

Termination

  • Termination: CaulSult may terminate or suspend the Service upon breach of these Terms.
  • Effect of Termination: Upon termination, User's access to the Service and Data will cease.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Lagos/Nigeria. Any disputes shall be resolved through binding arbitration.

Changes to Terms

CaulSult reserves the right to modify these Terms. Changes will be effective upon posting.
